Terms of service

1. Who we are and acceptance

These Terms of Service ("Terms") govern access to and use of the OnTopic service ("the Service"), available at be-on-topic.com, operated by Colin Galtier, an individual (not yet incorporated), based in Toronto, Ontario, Canada, contact 18 Yonge Street, Toronto, ON M5E 1Z8, Canada, contact@be-on-topic.com ("we", "us"). Once an entity is incorporated, these Terms will be updated with its legal name and business number.

By creating an account or using the Service, you accept these Terms and our Privacy Policy.

2. The Service

OnTopic generates personalized books with the help of artificial intelligence, from a topic and answers you provide, and lets you read those books and, if you wish, receive them on an e-reader (Kindle or Kobo).

3. Account

• You must create an account to use the Service, with a valid email address (or via Google sign-in).
• You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.
• You must be at least 18 years old to use the Service.

4. Subscription, pricing, and payment

• Subscription. The Service is offered on a subscription basis. The price, the billing frequency (for example monthly or annual), and the number of books included per period are shown clearly on the subscription page before any payment, in US dollars (USD). By subscribing, you accept the price and frequency displayed at that time.
• Free trial. A free trial may be offered to new accounts (for example, generating a first book). Its terms and duration are shown before you begin. Starting a new generation beyond the trial may activate the paid subscription, as indicated on screen.
• Automatic renewal. Your subscription is continuous and renews automatically at the end of each period, at the then-current price, until you cancel. You authorize us and our payment provider Stripe to charge your payment method on a recurring basis. We do not store your card data.
• Cancellation. You may cancel at any time, at no cost, from your account area. Cancellation takes effect at the end of the current period: you keep access until then, and no partial or current period is refunded. No renewal is charged after cancellation.
• Gift and promo codes. Codes may be offered; they grant complimentary access for a limited time, subject to their own terms (validity period, number of uses). When the complimentary access expires, continued use of the Service requires a paid subscription.
• Refunds. Books are digital content generated immediately at your request. Once the generation of a book has started, no refund is due for that book. A refund may be granted, at our sole discretion, only in the event of a technical failure on our part that prevents us from providing the Service.
• Right of withdrawal (EU/UK consumers only). If you are a consumer in the EU or UK, digital content is supplied immediately at your request. By launching the generation of a book, you expressly request that performance begin immediately and you acknowledge that you lose your 14-day right of withdrawal for that content once generation has started.

5. Nature of AI-generated content

• Books are generated automatically by artificial intelligence. The content may contain inaccuracies, errors, or approximations.
• The content is provided for information and entertainment. It is not professional advice (medical, legal, financial, or otherwise), and you are responsible for how you use it.
• You agree not to use the Service to generate illegal, defamatory, hateful content, or content that infringes the rights of others.

6. Ownership of content

• Subject to payment, you hold usage rights to the books you generate, for your personal use only. Any commercial use (resale, redistribution for profit) is not permitted without our prior agreement.
• We retain all rights to the Service itself (software, brand, design).

7. E-reader delivery

• Delivery to Kindle (by email) and to Kobo (via Dropbox) is offered as an option and depends on third-party services (Amazon, Dropbox).
• We do not guarantee the permanent availability of these third-party integrations, which may change independently of us.

8. Acceptable use

You agree not to:

• attempt to disrupt, overload, or circumvent the Service's protections;
• use the Service in an automated or abusive manner;
• impersonate a third party or provide false information.

We may suspend or terminate an account for breach.

9. Termination

• You may delete your account at any time from the Service; your data is then erased in accordance with the Privacy Policy.
• We may suspend or terminate access in the event of a violation of these Terms.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the extent permitted by law, we are not liable for indirect damages arising from use of the Service or of AI-generated content, nor for inaccuracies in the generated content. To the extent permitted by law, our total liability is limited to the amount you paid for the Service in the twelve (12) months before the event giving rise to the claim.

11. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. The courts of Ontario have jurisdiction, without prejudice to mandatory consumer-protection rights you may have in your own country or state that cannot be waived by contract. 12. Changes to these Terms

We may update these Terms. For material changes, we will notify you by email or through the Service. The last-updated date appears at the top of this document.
